Source: This EULA is based on Apple's Standard End User License Agreement Available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ End User License Agreement (EULA) for CycleWise Last Updated: June 2025 LICENSED APPLICATION END USER LICENSE AGREEMENT This Licensed Application End User License Agreement ("Agreement") is between you and CycleWise ("Application Provider") and governs your use of the CycleWise application ("Application") made available via the Apple App Store. By downloading the Application, you agree to be bound by this Agreement. 1. Scope of License a) You are given a non-transferable, non-exclusive, non-sublicensable license to install and use the Licensed Application on any Apple-branded Products that You own or control and as permitted by the Usage Rules. b) This license does not allow you to use the Licensed Application on any Apple-branded Products that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. 2. Restrictions You may not: (a) reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to the source code of the Licensed Application; (b) modify, adapt, alter, translate, or create derivative works of the Licensed Application; (c) distribute, license, loan, lease, sell, rent, or otherwise transfer the Licensed Application to any third party. 3. Privacy CycleWise operates on a privacy-first principle. All your personal data stays on your device. We do not collect, store, transmit, or analyze any of your personal information on external servers or cloud services. For complete privacy details, please refer to our Privacy Policy. 4. Termination This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and delete all copies from your devices. 5. Disclaimer of Warranties THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION PROVIDER DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY. 6. Limitation of Liability TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE APPLICATION PROVIDER BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA. 7. Apple's Role Apple is not a party to this Agreement and is not responsible for the Licensed Application or its content. Apple has no obligation to furnish maintenance and support services for the Licensed Application. 8. Third Party Terms of Agreement You must comply with applicable third-party terms of agreement when using the Licensed Application. 9. Intellectual Property Rights The Application Provider represents and warrants that it has the right to enter into this Agreement and grant the license herein. 10. Legal Compliance You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo. 11.
